General terms and conditions of sale

All the elements present on this site are the property of Coralie Bijasson. Any reproduction, integral or partial, must systematically be submitted to the authorization of Coralie Bijasson. The patterns are sold for a private use. Any reproduction, adaptation or use for commercial purposes is forbidden.

The customer, prior to his order, declares that the acquisition of these products is not directly related to his professional activity, their acquisition being reserved for a strictly personal use.

Clause n° 1 : Object

The present general terms of sale (GTS) detail the terms and conditions of the proposal and sale of products to its customers by the company Coralie Bijasson Créations on the website " coralie-bijasson.com ". Any order implies the full acceptance of these general conditions of sale which aim to define the rights and obligations of the parties in the context of the online sale of goods proposed by the company Coralie Bijasson Créations.

Clause n°2 : Acceptance of the conditions

When validating any order, the customer acknowledges having read these general conditions of sale and agrees to accept them without reservation.

Clause n° 3 : Creation of a customer account

Any person can freely and for free create a customer account through the "Create an account" section.
The creation of a customer account is done by filling out the form that is offered to the user of the Site. This account is strictly personal and allows the User to identify him/herself before validating each Order.
When creating a Customer Account, the Customer enters the information required for identification under his or her own responsibility, control and direction and undertakes to provide complete, accurate and up-to-date information and not to impersonate any third party or to conceal or change his or her age.
When creating a Customer Account, the Customer chooses a login (e-mail) and password. If the chosen identifier is already assigned, the system invites him to choose another one.
The login and password are personal and confidential. If Coralie Bijasson Créations takes all the necessary precautions and commits itself to protect the personal data of its Customers, the Customer is informed of the necessity to keep his password secret and not to disclose it to a third party, for any reason whatsoever. In case of suspicion of the use of the login and password by a third party, the Customer shall immediately notify Coralie Bijasson Créations in order to change his password and/or choose to close his customer account. Coralie Bijasson Créations reserves the right to close any customer account and consequently refuse any sale to a Customer in case of non-payment of one or several previous Orders. In this case, the company Coralie Bijasson Créations will send an e-mail to the concerned Customer at the address communicated by the latter when creating his customer account, informing him of the deactivation of his login and password and the closing of his account. A notice of eight (8) calendar days is granted to the Customer so that he can possibly make his observations to Coralie Bijasson Créations, without prejudice of the suspension of his Account during the notice period. In general, the Customer is informed that his account can be closed following the first request of the Customer sent by email to Coralie Bijasson Créations.

Clause n° 4 : Order

The order is considered as effective after validation of the payment. This validation is sent by Paypal. The company Coralie Bijasson Créations reserves the right to cancel any order if there was a dispute about the payment of a previous order.

Clause n° 5 : Prices

The prices of the goods sold are those in force on the day the order is taken. All the prices are indicated in Euros and take into account the French VAT in force. Any change in the VAT rate could be immediately reflected in the prices. Consequently, they will be increased by the transport costs applicable on the day of the order. The shipping costs depend on the weight, on the destination of the goods and on the tariffs practiced by La Poste at the time of the order. The company Coralie Bijasson® grants itself the right to modify its prices at any time. However, it commits itself to invoice the ordered goods at the prices indicated at the time of the registration of the order.

Clause n° 6 : Terms of payment

The payment of the orders is carried out :
either by credit card ;
or by gift card;
or by PayPal balance.

The payments will be made under the following conditions:
Immediate payment after ordering.

Clause n° 7 : Retention of title clause

Intellectual property

All the elements of the website (brand, domain name, products, images, videos, texts) are the exclusive property of Coralie Bijasson and are protected by copyright, trademarks or patents.

Property

The company Coralie Bijasson Créations keeps the property of the sold goods until the complete payment of the price, in principal and in accessories.

Clause n° 8 : Delivery

Materialized products
The delivery is made :
either by colissimo ;
or by La Poste.
The delivery time indicated at the time of the registration of the order is given only as an indication and is not guaranteed.

Consequently, any reasonable delay in the delivery of the products will not give place to the profit of the purchaser to :
the allocation of damages and interests;
the cancellation of the order.
The transport risk is borne in full by the buyer.

In the event of missing or damaged goods during transport, the buyer must formulate all necessary reserves on the order form upon receipt of the said goods. These reserves will have to be, moreover, confirmed in writing in the 7 days following the delivery, by registered mail addressed to the company.
The company Coralie Bijasson Créations cannot be held responsible for the errors made by the customer in the wording of the coordinates of the recipient of the order, and for the delays of delivery or the impossibility to deliver the ordered products that these errors could generate.

Immaterialized product
The delivery is made :
either by email via a downloadable file;
or by order history where you will find the file on your account.

Clause n° 9 : Retraction

The customer has 7 days from the reception of the ordered products to return them to the company Coralie Bijasson Créations for exchange or refund. In this case, the customer will have to send back the new and intact products to 34 avenue du Roule, 92200 Neuilly sur Seine. The return costs remain the responsibility of the customer.
In case of exercise of the right of withdrawal and if the products are intact and in perfect condition for resale, Coralie Bijasson Créations commits to refund the sums paid by the customer within a maximum of 30 days.

Clause n° 10 : Complaint, settlement and dispute

At the reception of the order, the customer has to check the state of the packaging and of the goods and to inform us of any damage within 7 days.
The company Coralie Bijasson Créations can not be held responsible for damages of any kind, both material and immaterial or corporal, which could result from the misuse of products marketed.
The responsibility of the company Coralie Bijasson Créations will be, in any case, limited to the amount of the order.

Clause n° 11 : Force majeure

The responsibility of the company Coralie BijassonCréations cannot be implemented if the non-execution or the delay in the execution of one of its obligations described in the present general conditions of sale results from a case of force majeure. Neither party shall have failed to perform its contractual obligations to the extent that their performance is delayed, hindered or prevented by an act of God or force majeure.

Will be considered as fortuitous event or force majeure all facts or circumstances irresistible, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which could not be prevented by these last ones, in spite of all the efforts reasonably possible. The party affected by such circumstances shall notify the other within ten working days of the date on which it becomes aware of such circumstances. The two parties will then, within one month, unless the force majeure event makes it impossible, meet to examine the impact of the event and agree on the conditions under which the performance of the contract will be continued. If the case of force majeure lasts for more than three months, these general conditions may be terminated by the injured party. Expressly, are considered as force majeure or fortuitous events, in addition to those usually retained by the jurisprudence of the French courts and tribunals: the blocking of means of transport or supplies, earthquakes, fires, storms, floods, lightning, the stoppage of telecommunication networks or difficulties specific to telecommunication networks external to the customers. In this respect, force majeure is defined as any external, unforeseeable and irresistible event within the meaning of Article 1148 of the Civil Code.

Clause n° 12 : Competent court

Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law.
In the absence of amicable resolution, the dispute will be brought before the Commercial Court of the Hauts-de-Seine.

Clause n° 13 : Acceptance and cancellation

The company Coralie Bijasson Créations confirms to the customer his order by e-mail within 48 hours (except orders placed on Fridays, Saturdays, Sundays and holidays). The customer is invited to print his order summary. Any order is considered firm and can only be cancelled with the express consent of Coralie Bijasson Créations and under conditions that will compensate it for any prejudice or damage caused by this cancellation.

Clause n° 14 : Personal data protection

The Customer is informed and accepts that his personal data can be collected on the Site and used by the company Coralie Bijasson Créations which acts as a controller in the sense of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter "General Data Protection Regulation" or "GDPR").
The company Coralie Bijasson Créations undertakes to protect and ensure the security and confidentiality of the personal data of its Customers in accordance with the RGPD, in particular by taking all useful precautions to prevent that these data are distorted, damaged or that unauthorized third parties have access to them.
The Client's personal data is collected for the following purposes

To exercise one or more of the Data Protection Rights, the Customer must send a request by email or by mail to the company Coralie Bijasson Créations, 34 avenue du Roule 92200 Neuilly or contact@coralie-bijasson.com
Each request must be signed and accompanied by a photocopy of an identity card bearing the Customer's signature and specify the reply address.
The answer to the request exercised on the basis of one or more Data-processing Rights and Freedoms will be addressed within 2 months following the reception of the request.
The Customer can communicate to the company Coralie Bijasson Créations particular directives in which he or she defines the way he or she intends to exercise, after his or her death, the Data-processing Rights and Freedoms in accordance with the RGPD.

Clause n° 15 : Commercial offers and newsletter

The company Coralie Bijasson ® is likely to send to the Customers information related to the Articles of the brand and commercial offers by mail, email, sms, phone or via all the web spaces animated by the company Coralie Bijasson Créations on the social networks, subject to prior acceptance.
The Customer has at any time the right to oppose without any cost to these commercial prospecting sendings, by clicking on the link "unsubscribe" appearing in each email or, by making the request via his internet account, by mail or by answering STOP by SMS

Clause n° 16 : Cookies

Thus, during the consultation of the coraliebijasson.com website, information related to the navigation may be recorded in "Cookies" files installed on the user's terminal (computer, tablet, smartphone, etc.).
